Terms and Conditions of Sale - Launch Edition
Hello and welcome to our Terms and Conditions of Sale. We - Supersmith - sell directly to consumers, in the UK (excluding Northern Ireland). This document is important because it sets out the parameters for sale and should be read in conjunction with our Intended Use Statement and Product Manual for the 3Scooter (available on our website www.supersmith.co), to ensure the product is being used for the right purpose, in the right way.
Please read these terms carefully and make sure you understand them, before ordering any products from us. You must be over 18 years of age to make the purchase and you will be asked to agree to these terms on purchase.

These Terms are governed by the laws of England and Wales.

These Terms apply to sales to UK consumers only, purchasing for personal use in the UK excluding Northern Ireland.

We may make immaterial changes to these Terms from time to time. For example, a re-ordering of the points or structural changes within this document or clarity on an expressed term.

These Terms, and any Contract between us, are only in the English language.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are purchasing for business purposes, different terms will apply. Please contact us if you are a business customer.

By placing an order, you agree to be bound by these Terms and Conditions of Sale and at this point our contract of sale commences.

Product Information

Our 3Scooter is a Class 2 Mobility Scooter, a certified medical device with electrical and mechanical components.

You should refer to The Product Manual on our website www.supersmith.co for information on how to use it. You are responsible for following all safety instructions and user manuals, including our Intended Use Statement.

It is not suitable for users over 120kg or those who are unable to stand unaided. You should refer to our Intended Use Statement for further information.

We take reasonable care to ensure product descriptions, specifications, and prices are accurate.

On our website and marketing material, Images are for illustrative purposes only; colours and finishes may vary slightly. Your product may vary slightly from images and specifications due to manufacturing tolerances.

Mobility scooters are supplied in accordance with applicable UK regulations and standards.

Performance (including range and speed) may vary depending on user weight, terrain, battery condition, and usage.

It is your responsibility to ensure the scooter you purchased is suitable for your intended use and complies with relevant road and pavement rules.

We are not responsible for issues arising from misuse or failure to follow instructions.

Pricing, Payment and VAT

Prices are shown in pounds sterling (£) and both inclusive and exclusive of VAT.

VAT may be charged at the applicable rate unless you qualify for VAT relief.

Where VAT relief is claimed, you confirm that:

You are eligible under HMRC rules; and

The information you provide via our website is accurate and complete.

We reserve the right to recover VAT if relief is incorrectly claimed.

Payment is taken in full on order and must be completed on Shopify via our website.

We accept the payment methods listed on our website.

If payment is declined or reversed, we may cancel your order.

Delivery

Lead times for delivery are detailed on our website.

Delivery times are expressed as estimates, not guarantees. We will endeavour to honour these timeframes but some circumstances may be beyond our control.

If for any reason we are unable to honour this timeframe you are eligible for a refund.

Delivery is normally made to the address provided at checkout. If no one is in or the product is unable to be delivered this will need to be rearranged with our logistics provider. This delivery can be rearranged once without incurring additional charges.

The title of goods and risk passes to you upon delivery.

You should inspect the goods on delivery and notify us of any damage or missing items as soon as reasonably possible and within 5 days.

Refunds

If you purchase a 3Scooter you have the right to return the product within 30 days of receiving it.

To return the product you must notify us clearly by email to hello@supersmith.co

You must take reasonable care of the 3Scooter. We may reduce your refund if the product shows excessive use, handing, wear, or mileage prior to return.

Faulty Goods and Your Legal Rights

Our goods must be of satisfactory quality, fit for purpose and as described on our website.

We may suspend the supply of goods if we believe there is a technical issue with the product or a change in law.

If there is something wrong with the product, please contact us and we may inspect them and may either repair or refund you.

Warranty

We will provide a manufacturer’s warranty in addition to your legal rights.

Warranty terms will be supplied with the product.
-
The Warranty will have some exclusions and should be reviewed by the customer.

Servicing and Maintenance

Regular servicing and maintenance is required to ensure safe operation. See Product Manual for details.

You are eligible for free service after 6 months carried out by a Supersmith technician at one of our Experience Centres.
-
You are responsible for routine maintenance unless a service plan is agreed in writing.
-
Use of unauthorised parts or repairs may affect warranty coverage.

Liability

You are responsible for using the 3Scooter in the way set out in the Product Manual. Supersmith is not liable for unexpected or unforeseeable losses.

Supersmith is not liable for losses resulting from:

Misuse of the product.

Failure to follow instructions in the Product Manual.

Unauthorised modifications.

Nothing in these Terms limits or excludes liability for:

Death or personal injury caused by negligence

Fraud or fraudulent misrepresentation

Defective products under the Consumer Protection Act 1987

Data Protection

We process personal data in accordance with UK data protection law.
